Originalism literally drives me into a blind rage - the justices piously claim to be it, right up until they need a conservative policy outcome, and then they just make shit up (major questions doctrine, qualified immunity).
Blind rage is such an apt description. Republicans cause a problem, blame it on the Dems, and then promise to fix it. WHY do people keep falling for it?!
Also, I love this essay. It breaks down a lot of big things into manageable parts. I'm a court watcher (and a historian) but I get that it's overwhelming/ignorable for most people because it can be a. lot.
Can you recommend anyone to follow for someone new to watching the courts? I’m starting to get more engaged with them as I anxiously await the opinion due soon on United States vs. Skrmetti. I follow local and national organizations that keep me updated about LBGTQ legislation because that will impact my family directly. I’d like to expand into watching other important issues.
I highly recommend Leah Litman’s podcast that she co-hosts with two colleagues called Strict Scrutiny. They discuss recent Supreme Court decisions and themes, it’s a great place to start!
Just put a hold on Lawless from my library. My book group's raison d'être is 'reading to understand' and the book for June is Love Wins - Lawless will be a great companion read.
